Workplace Injury Leads to $70,000 in Fines for Employer

“A Saskatoon company pleaded guilty to one count under
Occupational Health and Safety regulations in Saskatoon Provincial Court on
August 22, 2018.
Wright Construction Western Inc. pleaded guilty to
contravening clause 12(a) of the regulations (being an employer at a place of
employment, fail in the provision and maintenance of plant, systems of work and
working environments that ensure, as far as is reasonably practicable, the
health, safety, and welfare at work of the employer’s workers, resulting in the
serious injury of a worker).
The company was fined $50,000 plus a surcharge of $20,000.
One additional charge was stayed.
Charges resulted from an incident that took place on January
30, 2017 in Saskatoon. A worker
sustained a serious hip injury after the scissor lift the worker was unloading
from a flatbed trailer drove off the ramp and overturned.

Safety in the Workplace
Injured workers can request help with their WCB claims and
appeals through the Office of the Worker's Advocate.

Prevention is the first line of defence when it comes to
workplace safety. Find information on how to prevent workplace injuries, tips
on keeping employees safe, and policies on violence and harassment in the
workplace.
It is everyone’s responsibility to maintain a healthy and
safe workplace. Information for Occupational Health Committees and Occupational

Penalties and Fines
Penalties (fines) related to occupational health and safety
contraventions are an important mechanism for ensuring compliance with The
Saskatchewan Employment Act and are a strong deterrent for those who would
choose to be non-compliant.
Section 3-79 of The Saskatchewan Employment Act outlines the
increase to penalty amounts. Increased penalties will act as stronger
deterrents to those who would disregard the provisions of the Act and place
workers in harm's way. In addition to these increases, subsections 3-79(7),
(8), and (9) outline the maximum penalties associated with offences that cause
the serious injury or death of a worker(s).
Many of the penalties have been doubled from their previous
levels and additional penalties have been established.
Subsections 3-79(7) and (9) of The Saskatchewan Employment
Act establish maximum penalties for individuals or corporations who are
convicted of offences that cause serious injuries or fatalities. The maximum fine for individuals is $500,000
and for corporations is $1,500,000.
While the maximum penalty is set by legislation, the actual amount
charged to an individual or corporation is at the discretion of a judge.
At $1,500,000 for a corporation, Saskatchewan now has the
highest penalty for incidents causing the death or serious injury of a worker
in Canada. This penalty is comparable
to:
British Columbia whose maximum penalty for a first offence
is $618,730.69, with subsequent offences increasing to $1,237,461.35;
Alberta whose maximum penalty for a first time offence is
$500,000, with subsequent offences increasing to $1,000,000; and
Manitoba whose maximum penalty for a first time offence is
$150,000, with subsequent offences increasing to $300,000.

Parts III, IV, V and IX How to Read the
Act To read about the Occupational Health and Safety legislation
for the ‘General duties ... to have a Prime Contractor, while others
will not.
Knowing how to read and use the OHS legislation will help employers, supervisors and workers:
• familiarize themselves with Saskatchewan’s health and safety requirements; and
• take the correct actions to comply with the health and safety requirements for their specific workplaces. Reading legislation is different than reading a textbook or manual. Information is organized and presented in a unique way.
How to Read the Act:
The Saskatchewan Employment Act is 12 pieces of employment, labour relations and occupational health and safety requirements published and presented as one statute. It is organized into Parts designated by roman numerals. The OHS legislation is located in Parts III, IV and V of the Act.
• Part III - Occupational Health and Safety
• Part IV - Appeals and Hearings
• Part V - Radiation Health and Safety
When reading the Act, you will often be looking for one specific piece of information. It is best to go directly to the Table of Contents. Note that the Table of Contents is divided into Parts, as mentioned above, and the Parts are subdivided into Divisions. The OHS Divisions are then divided further into Sections. When trying to locate information in the Act, always remember to search by section number; not page number. For example, if you needed to find information about the General duties of supervisors, you would follow these steps.
1. Go to the Table of Contents.
2. Find Part III- Occupational Health and Safety.
3. Scan to find the OHS Division heading – Duties.
4. Finally, under Duties, you will see section 3-9, General duties of supervisors.
Note: Every section of Part III of the Act is preceded by the number 3. Similarly, if you were reading Part II of the Act, every section would be preceded by the number 2. See the screen capture on the next page for a visual example of what the Act’s Table of Contents looks like. The General duties of supervisors are highlighted. Notice that they are located in Part III, Division 3, section 3-9.
